What the law actually says

Section 24(B)(1) of the National Internal Revenue Code, as amended by the TRAIN Law (RA 10963), lists passive income of individuals subject to final tax. It includes a 20% final tax on prizes over ₱10,000 and on "other winnings," except PCSO and lotto winnings of ₱10,000 or less, which are exempt. Before TRAIN, all PCSO winnings were exempt; since 2018, larger PCSO prizes are taxed.

A "final tax" means the tax withheld is the full tax on that income. You don't add it to your annual return or pay more later. The payer is meant to withhold it.

Casino and sports betting wins in practice

This is the grey part. By its wording, "other winnings" can cover casino and betting wins. But withholding depends on the payer, and practices at casinos and betting operators have varied. Most casual players never see tax withheld on routine wins, and there's little record of the BIR going after individual casual players for unwithheld gambling winnings.

What does that mean for you?

Offshore and crypto payouts

Offshore sites don't withhold Philippine tax. In principle, Philippine residents are taxed on worldwide income, and winnings could be reportable. In practice, the question that comes up most often isn't the BIR but your bank or exchange asking where a large deposit came from under anti-money-laundering rules. Crypto adds a second layer: if your winnings in BTC rise in value before you sell, that gain is a separate matter. See our crypto gambling legal guide for the legal side.

Can I deduct losses?

For individual casual players, there's no clear, commonly used mechanism to deduct gambling losses from winnings in the Philippines. Final taxes are applied per payout, not on your net for the year. If you win ₱50,000 on one bet and lose ₱60,000 over the month, a withheld final tax on that win isn't refunded because of the losses.

How to document a big win

  1. Screenshot the win with the date, bet details and payout.
  2. Export your account history showing deposits, bets and withdrawals.
  3. Keep withdrawal confirmations and the matching bank or exchange records.
  4. Ask for any tax certificate if the operator withheld tax.
  5. Store everything for several years in a safe place.

Good records answer bank questions quickly and protect you if anything is challenged later.

When your bank asks questions

Banks and e-money issuers are covered persons under the Anti-Money Laundering Act and must understand unusual transactions. A large incoming transfer from a casino, an exchange or abroad can trigger a call or a request for documents. This is routine, not an accusation. Explain the source and provide your records. Never try to split deposits to stay under reporting thresholds; structuring itself raises red flags.

Worked examples

Lotto win of ₱8,000

Exempt. You receive the full ₱8,000.

Lotto win of ₱1,000,000

PCSO withholds 20%, or ₱200,000. You receive ₱800,000, and that's your full tax on the win.

Online slot jackpot of ₱400,000 at a licensed operator

Ask support how large payouts are handled and whether tax is withheld. If it is, get the paperwork. If not, keep records and consider advice.

Parlay win of ₱120,000 on an offshore book

No withholding. Keep your bet slip and withdrawal records. If you convert crypto to pesos, expect possible exchange questions.

Scams that use "tax" as bait

If a site or "agent" says you must pay tax, a "BIR clearance," or an "AMLC fee" before you can withdraw winnings, it's almost certainly a scam. Real withholding is deducted from the payout, not paid separately by you upfront. Stop paying and report to the CICC (1326).

Common questions people ask after a big win

"Should I declare it on my ITR?"

Income subject to final tax is generally not included in your annual income tax return. For winnings where nothing was withheld, whether and how to report is exactly where professional advice helps.

"Will the BIR know?"

Licensed operators keep records, and banks keep transaction histories. Assume large movements are visible.

"Is it different for OFWs?"

Non-resident citizens are generally taxed in the Philippines only on Philippine-source income, but the rules for winnings and the host country's laws both matter. Get advice in both places for large sums.

Non-cash prizes and promo winnings

Not every win is cash. Casino promos and raffles sometimes give out cars, gadgets or travel. Non-cash prizes over ₱10,000 are generally valued at fair market value and subject to the same 20% final tax, which the sponsor typically collects from the winner before handover. That's why some winners are asked to pay an amount before claiming a car. This is legitimate only when it comes from a known, licensed sponsor with official receipts; a stranger on social media asking for "tax" before you claim a prize you never entered is a scam.

What about bonuses and free bets?

Bonus credit and free bets aren't cash until you meet wagering requirements and withdraw. Many players ask whether bonuses are taxable on their own. Practically, attention focuses on actual withdrawn winnings, not bonus balances you haven't cleared. Keep in mind that bonus terms often cap what you can win from bonus money.

Spending a big win wisely

Professional help worth paying for

For a life-changing amount, a short consultation with a CPA or tax lawyer is cheap insurance. Bring your records: account statements, screenshots and any withholding certificates. Ask specifically about whether reporting is needed, how to document source of funds for property or vehicle purchases, and how crypto gains are treated if you held winnings in coins.

Keeping winnings separate

One simple habit makes everything easier: use a dedicated bank or e-wallet account for betting deposits and withdrawals. Your history is then clean and easy to explain, you can see your real net results at a glance, and it's harder for betting money to leak into bills and savings without you noticing.

Taglish recap
